By accessing or using AvertXAI products and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

AvertXAI provides an AI-assisted enterprise platform including lead management, biometric authentication, and related software tools. Features may be modified, added, or removed at our discretion.

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Services. By using the Services, you represent that you meet these requirements.

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activity occurring under your account
• Notifying us immediately of unauthorized access

5. Acceptable Use

You agree not to:

• Reverse engineer or attempt to extract source code
• Use the Services for unlawful or fraudulent purposes
• Interfere with or disrupt platform security or integrity
• Attempt unauthorized access to any system or data

All content, software, and technology comprising the Services are the exclusive property of AvertXAI and protected by applicable intellectual property laws. No license is granted except as expressly stated herein.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERTXAI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

9. Arbitration & Dispute Resolution

Any dispute arising under these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association. You have 30 days from the Effective Date above to opt out of arbitration by emailing [email protected].

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
